1. Trasporto e consegna

1.1

Per ogni ordine effettuato sul Sito, Still Very Reggiani SA emette fattura dei Prodotti spediti, inviandola tramite e-mail o posta all’intestatario dell’ordine. Per l’emissione della fattura fanno fede le informazioni fornite dal Cliente all’atto dell’ordine. Nessuna variazione in fattura sarà possibile, dopo l’emissione della stessa.

1.2

Le spese di consegna sono a carico del Cliente e sono distintamente evidenziate nel modulo d’ordine.

1.3

Tutti gli acquisti verranno consegnati  tramite corriere espresso e posta svizzera, a partire dal giorno lavorativo successivo alla data di conferma dell’accettazione della proposta d’ordine, sulla base della disponibilità indicata. Still Very Reggiani SA non è responsabile per ritardi non prevedibili e/ o imputabili al corriere.

1.4

In ogni caso, salvo i casi di forza maggiore o caso fortuito  i Prodotti saranno consegnati entro un termine massimo di 30 (trenta) giorni a decorrere dal giorno successivo a quello della conclusione del contratto in conformità al paragrafo 7.1 che precede, salvo che Still Very Reggiani SA non comunichi – entro lo stesso termine o entro la data ultima concordata per la consegna, anche tramite posta elettronica – l’impossibilità di consegnare i Prodotti ordinati a seguito della sopravvenuta indisponibilità, anche temporanea, dei Prodotti. In caso di tale comunicazione, Still Very Reggiani SA provvederà al rimborso delle somme eventualmente già corrisposte dal Cliente per il pagamento della fornitura.

1.5

Nel caso in cui, a fronte della comunicazione di Still Very Reggiani SA di un ritardo nella data di consegna, il Cliente desideri annullare l’ordine, l’eventuale importo già pagato dal Cliente sarà rimborsato il più presto possibile, e comunque non oltre 30 (trenta) giorni dalla data di ricevimento da parte di Still Very Reggiani SA della comunicazione di cancellazione dell’ordine.

1.6

Per la consegna dei Prodotti è necessaria la presenza del Cliente o di un suo incaricato all’indirizzo del destinatario indicato nell’ordine. Al momento della consegna dei Prodotti da parte del Corriere, il Cliente è tenuto a controllare:

(i) che il numero dei colli in consegna corrisponda a quanto indicato nel documento di trasporto (DDT);

(ii) che l’imballo risulti integro, non danneggiato, né bagnato o comunque alterato, anche nei materiali di chiusura. Eventuali danni all’imballo e/o al Prodotto o la mancata corrispondenza del numero dei colli o delle indicazioni devono essere immediatamente contestati per iscritto sulla prova di consegna del corriere. Una volta firmato il documento del corriere senza che il Cliente abbia opposto alcuna contestazione, il Cliente non potrà opporre alcuna contestazione circa le caratteristiche esteriori del pacco consegnato.

2. Conferma spedizione e consegna 

Still Very Reggiani SA invierà al Cliente una e-mail di conferma una volta spediti i Prodotti, nonché una successiva comunicazione a conferma della consegna effettuata.

3. Diritto di recesso e cancellazione ordini

3.1

Still Very Reggiani SA desidera garantire la completa soddisfazione del Cliente. Il Cliente ha diritto di recedere dal contratto, specificando il motivo e restituendo i Prodotti acquistati sul Sito entro il termine di 7 (sette) giorni lavorativi che decorrono dalla data di ricevimento dei Prodotti.

3.2

Per esercitare il diritto di recesso, il Cliente dovrà inviare al seguente indirizzo: info@protoxtype.com una e-mail contenente:

la manifestazione di volontà di avvalersi del diritto di recesso;

l’indicazione dei Prodotti per i quali il Cliente vuole avvalersi del diritto di recesso;

il numero progressivo d’ordine comunicato da Still Very Reggiani SA al momento della conferma dell’acquisto;

codice IBAN del Cliente, al fine di effettuare il rimborso.

3.3

In caso di esercizio del diritto di recesso, Still Very Reggiani SA rimborserà per intero il prezzo dei Prodotti a patto che questi vengano restituiti dal Cliente non indossati, non usati e non danneggiati, nonché accompagnati dalla relativa fattura originale, e con il packaging ProtoXtype. Still Very Reggiani SA accetterà resi e cambi di Prodotti che siano stati consegnati con un’etichetta o un adesivo o un sigillo di reso/cambio soltanto se le istruzioni di reso sopra riportate saranno correttamente rispettate e se l’etichetta o l’adesivo o il sigillo saranno intatti e attaccati al Prodotto.

3.4

Still Very Reggiani SA si riserva il diritto di rifiutare la restituzione di quei Prodotti che non risultino conformi a tali requisiti. In caso di Prodotti difettati, si applicheranno le disposizioni del paragrafo 15 “Difetti di conformità”. I rimborsi verranno effettuati con la medesima modalità di pagamento utilizzata per l’acquisto. Il prezzo dei Prodotti acquistati on-line non potrà essere rimborsato dai negozi ProtoXtype®.

3.5

Le spese per la restituzione dei Prodotti sono a carico del Cliente; qualsiasi spesa sostenuta dal Cliente per la riconsegna non sarà rimborsabile.

3.6

Still Very Reggiani SA si impegna a rimborsare il Cliente entro e non oltre 30 giorni dalla data di ricevimento da parte di Still Very Reggiani SA della comunicazione di cancellazione dell’ordine o di recesso.

3.7

Still Very Reggiani SA invierà una e-mail di notifica una volta effettuato il rimborso.

3.8

Si raccomanda di spedire i Prodotti da restituire assicurando l’intero importo del bene,e avendo cura di ricevere un numero di spedizione per consentire di rintracciare la spedizione. Still Very Reggiani SA non sarà responsabile per il rimborso o il risarcimento relativo a Prodotti spediti dal Cliente ma che non siano mai stati ricevuti da Still Very Reggiani SA a causa di perdita, furto o danneggiamento che non siano imputabili a Still Very Reggiani SA.

4. Difetti di conformità

Alla vendita dei Prodotti si applicano le garanzie legali previste dal diritto materiale svizzero, in particolare dalle norme previste nel Codice delle Obbligazioni.

1. Transport and delivery

1.1

For each order placed on the Site, Still Very Reggiani SA issues an invoice for the Products shipped, sending it by e-mail or post to the holder of the order. For the issuance of the invoice, the information provided by the Customer at the time of the order is valid. No change in the invoice will be possible after its issuance.

1.2

Delivery costs are charged to the customer and are clearly indicated in the order form.

1.3

All purchases will be delivered by express courier and Swiss post, starting from the working day following the date of confirmation of acceptance of the order proposal, based on the availability indicated. Still Very Reggiani SA is not responsible for unforeseeable delays and/or delays attributable to the courier.

1.4

In any case, except in cases of force majeure or unforeseeable circumstances the Products will be delivered within a maximum period of 30 (thirty) days starting from the day following that of the conclusion of the contract in accordance with paragraph 7.1 above, unless Still Very Reggiani SA does not communicate – within the same term or within the final date agreed for delivery, also by e-mail – the impossibility of delivering the Products ordered following the unavailability, even temporary, of the Products. In the event of such communication, Still Very Reggiani SA will refund any sums already paid by the Customer for payment of the supply.

1.5

In the event that, following communication from Still Very Reggiani SA of a delay in the delivery date, the Customer wishes to cancel the order, any amount already paid by the Customer will be refunded as soon as possible, and in any case no later than 30 (thirty) days from the date of receipt by Still Very Reggiani SA of the notice of cancellation of the order.

1.6

For the delivery of the Products, the presence of the Customer or his representative is required at the address of the recipient indicated in the order. Upon delivery of the Products by the Courier, the Customer is required to check:

(i) that the number of packages delivered corresponds to what is indicated in the transport document (DDT);

(ii) that the packaging is intact, not damaged, wet or otherwise altered, even in the sealing materials. Any damage to the packaging and/or the Product or the mismatch in the number of packages or indications must be immediately notified in writing on the courier’s proof of delivery. Once the courier’s document has been signed without the Customer having made any objection, the Customer will not be able to make any objection regarding the external characteristics of the delivered package.

2. Confirm shipment and delivery

Still Very Reggiani SA will send the Customer a confirmation e-mail once the Products have been shipped, as well as a subsequent communication confirming the delivery.

3. Right of withdrawal and cancellation of orders

3.1

Still Very Reggiani SA wishes to guarantee complete customer satisfaction. The Customer has the right to withdraw from the contract, specifying the reason and returning the Products purchased on the Site within 7 (seven) working days starting from the date of receipt of the Products.

3.2

To exercise the right of withdrawal, the Customer must send an email to the following address: info@protoxtype.com containing:

the manifestation of willingness to exercise the right of withdrawal;

the indication of the Products for which the Customer wishes to exercise the right of withdrawal;

the progressive order number communicated by Still Very Reggiani SA upon confirmation of the purchase;

Customer’s IBAN code, in order to make the refund.

3.3

In the event of exercise of the right of withdrawal, Still Very Reggiani SA will refund the full price of the Products provided that they are returned by the Customer unworn, unused and undamaged, as well as accompanied by the relative original invoice, and with the ProtoXtype packaging. Still Very Reggiani SA will accept returns and exchanges of Products that have been delivered with a return/exchange label or sticker or seal only if the above return instructions have been correctly complied with and if the label or sticker or seal will be intact and attached to the Product.

3.4

Still Very Reggiani SA reserves the right to refuse the return of those Products that do not comply with these requirements. In the event of defective Products, the provisions of paragraph 15 “Defects of conformity” will apply. Refunds will be made with the same payment method used for the purchase. The price of Products purchased online will not be refunded by ProtoXtype® stores.

3.5

The costs for returning the Products are charged to the Customer; any costs incurred by the Customer for the return will not be refunded.

3.6

Still Very Reggiani SA undertakes to reimburse the Customer no later than 30 days from the date of receipt by Still Very Reggiani SA of the notice of cancellation of the order or of withdrawal.

3.7

Still Very Reggiani SA will send a notification e-mail once the refund has been made.

3.8

It is recommended to ship the Products to be returned insuring the full amount of the goods, and taking care to receive a tracking number to allow tracking of the shipment. Still Very Reggiani SA will not be responsible for reimbursement or compensation relating to Products shipped by the Customer but which have never been received by Still Very Reggiani SA due to loss, theft or damage that are not attributable to Still Very Reggiani SA.

4. Conformity defects

The legal guarantees established by Swiss substantive law, in particular by the provisions of the Code of Obligations, apply to the sale of the Products.
